Employment Insurance Lump Sum Settlement
January 28, 2019 D/BU #92/2018-2019
Employment Insurance Lump Sum Settlement
To: Presidents and All Members
From: Brad Bennett, Associate General Secretary – Protective Services
For Information
The 2017-2019 Extension Agreement between OSSTF/FEESO and OPSBA/the CTA provided members with a
lump sum payment equal to 0.5% of wages earned during the 2016-2017 school year. The payment was in
recognition of potential expenses for professional development, supplies or equipment or for other
professional expenses. Members received the lump sum payment on or about November 1, 2017.
Some members who were on statutory leaves and receiving Employment Insurance benefits at the time
of the lump sum payment had their EI benefits “clawed back” because the lump sum was considered to
be earnings, despite the wording of the Extension Agreement that designated the amount as related
to expenses. OSSTF/FEESO supported those members who chose to appeal the decision to claw back
their EI benefits, and we are pleased to advise that a settlement on those appeals has now been
finalized.
As a result of this settlement, Service Canada will allow members who suffered a claw-back of EI
benefits due to the lump sum, but who did not file an appeal, to apply for reimbursement of
employment-related expenses.
Who Is Eligible?
Members are eligible to take part in the settlement if:
1. They were on statutory leave and in receipt of EI benefits during the time associated with the
lump sum payment, and
2. They were found to be in an overpayment situation because of the lump sum payment, resulting
in the clawing back of EI benefits.
What Types of Expenses Can Be Claimed?
• Members can be reimbursed for professional development, supplies or equipment or for other
professional expenses.
• In order for equipment expenses to be eligible, the equipment concerned must be primarily
used for employment purposes.
Congratulations on Your Retirement!
Congratulations Michelle Phillips on your retirement, 30 years of dedication!!!
